Google Crushes Home Decor Center’s Trademark Challenge to AdWords

Home Decor Center sued Google in the wake of the Fourth Circuit’s Rosetta Stone ruling. The lawsuit did not go well for it. Recently, the court granted Google’s summary judgment motion on two grounds. The trademark challenges were dismissed because the court held that “Home Decor Center” was generic and therefore ineligible for trademark protection. All of the non-trademark claims were dismissed per 47 USC 230. Thus, not only has Home Decor Center’s lawsuit died, so has its trademark.
