A Look Back at Friday’s Gene-Patent Ruling

- Let’s turn back to Friday’s big-deal ruling that the BRCA 1 and 2 genes, which have been linked to certain forms of breast and ovarian cancers, can be patented.
The ruling reversed a trial court holding that human genes are found in nature and thus cannot be subject to patent protection. And the appellate ruling also parted company with the Justice Department, which contends the genes at issue can’t be patented. On the flip side, the decision was a win for Myriad Genetics, which owns BRCA gene patents.
